An approved EB-2 NIW petition establishes a priority date. Filing an EB-1A does not forfeit it: once the EB-1A I-140 is approved, the earlier date can be retained and carried into the first preference category, so the time already spent in the EB-2 queue is not lost.

In practice this means Tech Executives with a pending or approved NIW keep it as a safety net while building the EB-1A record in parallel. If the EB-1A is approved, the adjustment moves to the faster category; if it is denied, the NIW and its date remain intact.

The two petitions can coexist. Nothing in the regulations requires withdrawing one to file the other, and each is adjudicated on its own record.
